The Climate Change Litigation Based Human Rights Approach in Corporations: Prospects and Challenges

Abstract

In recent years, the phenomenon of climate change has emerged as a critical global issue that poses a significant threat to human survival. Industries such as fossil fuels, manufacturing, and agriculture have been identified as major sources of greenhouse gas emissions. Corporate activities have played a role in triggering legal actions holding them accountable for their contribution to climate change. Therefore, this research analyses the prospects and challenges of climate change litigation against corporations in Indonesia using human rights approach. This research has adopted normative legal research with a statutory and historical approach. Descriptive analysis is applied to analyze the data. This paper reveals that the use of human rights approach can strengthen arguments against corporations over climate change. This paper concludes that despite the challenge that may arise, there is a big chance for successful climate change litigation against corporations in Indonesia by using human rights approach as the main claim.

Yordan Gunawan, Universitas Muhammadiyah Yogyakarta, Yogyakarta,

Yordan Gunawan is a Senior Lecturer at the Faculty of Law, Universitas Muhammadiyah Yogyakarta. He holds a Bachelor's degree from Universitas Muhammadiyah Yogyakarta and pursued further studies at the National Cheng Kung University in Taiwan, Republic of China. Additionally, he completed his studies at the Graduate Institute of International Studies in Geneva, Switzerland, obtaining a certificate in International Human Rights and Humanitarian Law.

Currently, Yordan is a PhD Researcher at the Department of International Law and International Relations, Faculty of Law, Universitat Pompeu Fabra, Barcelona, Spain.

His research focuses on Public International Law, International Dispute Settlement, Law of International Organizations, and International Environmental Law. Yordan actively contributes to the academic field by publishing articles in various national and international journals.

Furthermore, Yordan serves as the Chairman of the Association of International Offices of Muhammadiyah Higher Education Institution (ASKUI PTMA), leading over 90 International Offices in Indonesia. Mohammad Hazyar Arumbinang is a master student at Melbourne Law School, the University of Melbourne, Australia, funded by the Australia Awards Scholarship under the Department of Foreign Affairs and Trade, Australia.
